Stop Creditor Harassment

Once your bankruptcy case is filed (Chapter 7 or Chapter 13), a federal court order called the "Automatic Stay" is imposed immediately. The Automatic Stay immediately stops all creditor efforts to collect any debt from the debtor. It stops foreclosure actions, garnishments, lawsuits, judgments, repossessions, phone calls, delinquent notices and all other attempts to collect.

As an example, if a debtor files for bankruptcy and he/she is behind on their vehicle payments, the finance company cannot repossess the debtor's vehicle as long as the automatic stay is in force. If on the other hand, the finance company repossesses the car before the debtor files for bankruptcy then the debtor cannot get the car back because the automatic stay was put into effect after the collection effort occurred.
